Fair Debt Collection Practices Act

Although a creditor does have a right to contact you to collect past due debt, the Fair Debt Collection Practices Act sets forth limitations. For example:

  • Creditors cannot call your employer, friends, or family if you have directed them not to.
  • Creditors cannot call you at work if you have told them not to.
  • Creditors cannot harass you by using profane language.
  • Creditors cannot force you to pay for debt that you do not owe.
  • Creditors cannot threaten litigation simply to get you to pay the debt.
